About the Department

The Legal Affairs team provides legal advice internally across the organisation on a wide range of matters including enforcement and supervisory matters, as well as matters of an operational nature. It is also involved in the coordination and oversight of the legislative process in so far as laws administered by the MFSA are concerned. Moreover, Legal Affairs attends to any litigation matters and represents the Authority in any action or legal proceedings in which the MFSA is involved or has an interest in.

About the Role

Within this role you will be reporting to the General Counsel and will be responsible for performing the following tasks:

  • Tendering general legal advice and guidance on issues of a legal, administrative law nature or regulatory nature, including compliance, investigations and enforcement, and the identification and analysis of any legal risks thereof;
  • Vetting and/or drafting of agreements and other contracts as required (including regulatory appointments and/or engagements);
  • Drafting/vetting of Memoranda of Understanding to be entered into by the MFSA;
  • Assisting in the assessment of information requests received from other regulatory and/or enforcement bodies and also any other requests under MoUs, as may be required;
  • Reviewing and/or drafting of legislation, whether transposing EU law or otherwise;
  • Assisting the litigation team within the Legal Affairs function, as necessary;
  • Providing input/assistance to the EU & International Affairs Function, as may be necessary;
  • Briefing, instructing and coordinating with the Authority's external advisors in relation to new or ongoing assignments and/or projects as necessary;
  • Attendance at Parliamentary sittings and Parliamentary committee stage meetings, as required;
  • Attendance at any working groups and committees, both local and internationally, as may be necessary;
  • Undertake any other duties as assigned by the General Counsel and/or as may be required by the MFSA from time to time, based on the exigencies of the Legal Function and/or the MFSA in general.

About you

The role requires a University of Malta Degree in Law (LL.D. or Master of Advocacy level) or a comparable recognised legal qualification at National Qualification Framework Level 6 or better duly certified by the Malta Qualifications Recognition Information Centre (MQRIC), together with possession of a warrant to practice in the Courts of Malta. A post-graduate degree in a discipline relevant to the financial services sector would be considered an asset.

Candidates shall be in possession of at least six (6) years prior work experience in a senior level within a legal environment and exposure to financial services laws, preferably within a regulatory environment.

You will also have the below skillset:

  • Motivated and willing to expand your knowledge;
  • Great attention to detail;
  • Strong command of both Maltese and English (written and spoken);
  • High level of integrity.
